Terms of engagement

1. The parties

The Agency: Agencia Jade Home, represented by Mr Juan Carlos Moreno (DNI 51116877K), with business address at Calle José Abascal 44, 1º Dcha., 28003 Madrid, Spain. Email: agenciajadehome@gmail.com · Phone: +34 662 57 28 85.

The Client (employer): the individual or company named in the engagement form or in the online booking form, with the identification, billing and service-address details given there.

2. Purpose of the engagement and intermediation

The Client engages the Agency to select and introduce domestic staff. The Agency acts solely as a recruitment and introduction agency. The employment relationship is entered into directly and independently between the Client and the selected worker under Spanish Royal Decree 1620/2011; the Agency is not party to, and is released from, the resulting employment and social security obligations.

3. Quality commitment and liability insurance

The Agency will provide a diligent and professional service, ensuring that its activity complies with current legislation and is covered by professional civil liability insurance.

4. Selection process and interviews

The Agency will request the specifications and requirements of the position, screen the available candidates and check references from previous employment whenever feasible. Interviews will take place in person or online as the Client prefers. The final hiring decision rests with the Client in all cases.

5. Fees, payment and discount

The Agency's fees for a successful placement are set out below, plus the applicable VAT (21%):

• €900 per person hired full time.
• €450 per person hired part time.
• A minimum of €350 per person hired by the hour.
• First-placement offer: a 20% discount on the taxable amount of the fee for the first engagement. When booking online it is applied through the welcome coupon, which remains active for 60 minutes from the moment the Client adds it; after that, the Client may ask the Agency to apply it. Launch offer subject to availability and not combinable with other offers.
• When the fee is due: the invoice is issued and payment is made on the day the employment contract is formalised or the hired person starts work, using the payment method chosen by the Client. If the Client withdraws before hiring anyone, no charge whatsoever will be made.

6. Replacement guarantee

If the hired person does not pass the trial period or the relationship ends within three (3) months of hiring, the Client may request the selection of a new candidate at no extra cost. This guarantee covers a maximum of two (2) replacements. After the first replacement, the three-month guarantee period is renewed in full, starting again from the new person's start date, and applies on the same terms to the second replacement.

7. Direct hiring

If the Client directly hires any candidate introduced by the Agency within twelve (12) months of the introduction, without the Agency's involvement, the fees set out in clause 5 become payable in full and immediately.

8. Limitation of liability

The Agency's liability is strictly limited to the selection of candidates. The Agency is not liable for any damage, misconduct, theft or employment disputes arising in the Client's home after the selected person is hired.

9. Additional payroll services

Drafting employment contracts, social security registration and deregistration, and payroll are not included in this engagement unless the additional payroll service is expressly contracted.

10. Online contracting and confirmation

The engagement may be formalised by signing the engagement form or by accepting these terms in the website booking form, in three steps: choice of plan, billing details and acceptance. Before confirming, the Client can review and correct their details. After acceptance, the Agency sends a summary of the engagement with these terms as a PDF to the email address provided, which both parties keep on file. The contract is concluded in Spanish; the English version is a courtesy translation.

11. Right of withdrawal

Where the Client is a consumer, they may withdraw from the engagement within fourteen (14) calendar days of acceptance, without giving a reason, by notifying agenciajadehome@gmail.com or the Agency's postal address. The following model may be used but is not compulsory: "I hereby give notice that I withdraw from the selection engagement with reference ___, accepted on ___. Name, ID number, signature (if sent on paper) and date."

If the Client expressly asks for the selection to begin within that period, they acknowledge that the right of withdrawal will be lost once the service has been fully performed, that is, when the selected person starts work. As long as no one has been hired, withdrawal is free of charge.

12. Data protection

In accordance with the GDPR and Spanish Organic Law 3/2018, the data provided by the Client will be processed by Agencia Jade Home (data controller) to manage the requested selection and the invoicing of the service. The data will not be disclosed to third parties except where required by law or directly necessary for the service. The Client may exercise the rights of access, rectification, erasure, objection, restriction and portability by writing to the Agency's postal or email address. 13. Governing law and jurisdiction

This engagement is governed by Spanish law. Any dispute shall be submitted to the courts that are legally competent.
